1. DEPOSIT & PAYMENT TERMS

  • 1.1. Deposit: A 50% deposit is required to secure your booking and to confirm the allocation of resources and materials.
  • 1.2. Final Payment: The remaining balance is payable on the same day as installation completion.
  • 1.3. Payment Methods: Payments can be made via bank transfer, credit card, or other approved methods specified in the invoice.
  • 1.4. Late Payments: If the final payment is not received within 7 days of the installation date, a late payment fee of 5% of the outstanding balance may apply.
  • 1.5. RA Aircon & Electrical Pty Ltd reserves the right to suspend or disconnect the system after providing written notice.
  • 1.6. Retention of Title: Ownership and title of goods remain with RA Aircon & Electrical Pty Ltd until full payment has been received, in accordance with the Competition and Consumer Act 2010 (Cth).
 

2. CLIENT ACCEPTANCE

  • 2.1. Agreement to Terms: By paying the deposit or signing the acceptance form, the client acknowledges that they have read, understood, and agree to the terms and conditions outlined herein.
  • 2.2. Scope of Work: The client confirms that the quoted scope of work is accurate and comprehensive. Any additional works or variations must be approved in writing and may incur additional costs.
  • 2.3. Site Readiness: The client agrees to ensure the site is prepared and accessible for installation, including the removal of fragile items and providing necessary approvals for works.
  • 2.4. Acknowledgment of Exclusions: The client acknowledges that any exclusions (e.g., patching, painting, or external electrical rectifications) have been communicated prior to acceptance of the quote.
 

3. PATCHING AND PAINTING

  • 3.1. Due to variations in air conditioner sizes or original installation methods, patching and painting may be necessary after installation.
  • 3.2. Cutting access panels into walls for re-routing piping may also be required.
  • 3.3. While we take precautions to minimize disruptions, such works are not included in the quoted price and are the responsibility of your maintenance contractor.
 

4. WARRANTY

  • 4.1. Manufacturer’s Warranty: Domestic air conditioners are covered by a 5-year manufacturer’s warranty.
  • 4.2. Installation Warranty: A 12-month warranty applies to refrigeration gas and water leaks, starting from the invoice date. Note: Warranty claims are void if the system has been tampered with, improperly maintained, or serviced by unauthorized personnel.
 

5. OWNER-SUPPLIED GOODS

  • 5.1. Equipment and materials provided by the client are the sole responsibility of the client in relation to warranty claims.
  • 5.2. RA Aircon & Electrical Pty Ltd does not provide warranty coverage for client-supplied equipment but warrants the workmanship of the installation to meet industry standards.
 

6. SERVICE & MAINTENANCE

  • 6.1. Owners are responsible for ensuring proper operation and regular servicing of their air conditioning unit.
  • 6.2. Annual servicing is recommended to maintain performance and warranty validity. Failure to service regularly may void the warranty.
  • 6.3. Costs for follow-up investigations or repairs caused by lack of maintenance will be borne by the client.
 

7. BUILDING ACCESS & SITE CONDITIONS

  • 7.1. The client is responsible for providing safe and unhindered access to the installation site.
  • 7.2. RA Aircon & Electrical Pty Ltd operates in accordance with the Work Health and Safety Act 2011 (Qld). If hazards are identified, work may be delayed until they are resolved.
  • 7.3. Additional costs incurred due to delays or site conditions will be passed on to the client.
 

8. VARIATIONS AND EXTRA WORK

  • 8.1. Any variations or additional work requested by the client, or necessitated by unforeseen circumstances, will incur additional charges.
  • 8.2. Variations must be agreed upon in writing before the work is undertaken.
 

9. LIABILITY

  • 9.1. Pre-Existing Conditions: RA Aircon & Electrical Pty Ltd is not liable for:
    • 9.1.1. Faults or issues in pre-existing wiring, electrical infrastructure, or circuits that may affect the operation of the installed air conditioning unit.
    • 9.1.2. Damage or performance issues caused by inadequate or non-compliant existing electrical systems.
  • 9.2. Incidental Damages: While all reasonable precautions are taken, RA Aircon & Electrical Pty Ltd is not liable for incidental damages to property unless caused by gross negligence.
  • 9.3. Exclusions Liability: Liability does not extend to:
    • 9.3.1. Damage caused by power surges, voltage fluctuations, or external electrical faults.
    • 9.3.2. Misuse, neglect, or tampering by unauthorized personnel.
    • 9.3.3. Cosmetic damage that does not affect functionality.
  • 9.4. Rectification Works: Any rectification works required to bring systems up to standard will be quoted separately and must be approved by the client in writing before proceeding.
 

10. ENVIRONMENTAL DISPOSAL

  • 10.1. RA Aircon & Electrical Pty Ltd will responsibly dispose of old units or materials removed during installation.
  • 10.2. A disposal fee may apply, which will be outlined in the initial quote or discussed prior to removal.
 

11. CANCELLATION POLICY

  • 11.1. Cancellations must be made in writing at least 48 hours prior to the scheduled installation date.
  • 11.2. If a 50% deposit has been paid in full and cancellation is within 48 hours prior to the scheduled installation date, RA Aircon & Electrical Pty Ltd, will retain 25% of the deposit to cover administrative, scheduling, and restocking fees.
  • 11.3. A cancellation fee of 10% may apply to cover administrative and scheduling costs for any installations cancelled outside 48 hours of the scheduled installation date.
 

12. DISPUTES & CONSUMER RIGHTS

  • 12.1. RA Aircon & Electrical Pty Ltd complies with the Australian Consumer Law (ACL) and guarantees that services are provided with due care and skill, fit for purpose, and within a reasonable time.
  • 12.2. Any disputes must be raised within 14 days of installation. We are committed to resolving disputes promptly and fairly.
 

13. ACCEPTANCE OF TERMS

  • 13.1. Payment of the deposit or signature on the quote constitutes acceptance of these terms and conditions.
  • 13.2. This document forms part of the agreement between RA Aircon & Electrical Pty Ltd and the client and is enforceable under relevant legislation.
 

14. LEGAL BASIS FOR ACTION

  • 14.1. Under Australian Consumer Law, particularly the provisions enforced by the Australian Competition and Consumer Commission (ACCC), businesses are entitled to enforce payment terms agreed upon at the time of transaction.
  • 14.2. Section 62 of the Competition and Consumer Act 2010 (Cth) prohibits clients from engaging in “unconscionable conduct” by delaying or refusing payment for services.
